Reporters yesterday learned from the Institute of technical trade measures of Shenzhen Institute of standards and Technology (TBT Institute) that the United States intends to amend three draft technical regulations, including "children's products certification testing and labeling requirements", which is likely to urge foreign related products purchasers and retailers to formulate stricter procurement standards, resulting in the increasing production costs of Shenzhen and even domestic related enterprises.

In November 25th last year, the United States briefed the WTO Secretariat and other WTO members on the TBT Bulletin of the three technical regulations on the product certification testing and labeling requirements for representative samples of children's products.

One important content is to amend the "random sampling" required by the conformity test of children's products in the original federal regulations to "representative sampling".

The US Consumer Product Safety Commission (CPSC) explained that the test results of selected representative samples must be consistent with the test results of 100% unselected products in the same batch.


Li Meng, deputy director of the TBT of the municipal Standards Institute, believes that, on the face of it, the revision of laws and regulations is aimed at lightening the burden of enterprises. In fact, there are various kinds of children's products, and the relevant technical specifications and standards also cover many aspects such as chemical, mechanical and physical properties, flame retardancy and so on. However, the new draft law itself has not given further guidance to this, which may lead to the loss of our SMEs.

On the other hand, according to past experience, large purchasers and retailers abroad are likely to develop stricter ones based on their own understanding.

According to Liu Xiaona, director of the Shenzhen toy industry association, from January to September last year, the national toy export amount was 17 billion 487 million US dollars, of which Guangdong accounted for 10 billion 760 million US dollars, accounting for about 61.5%. The total export volume of about 600 toy production enterprises in Shenzhen was 3 billion US dollars, accounting for 17.16%.

Although the total export volume of toys in China has declined in recent years, the leading position of Shenzhen and even Guangdong is still stable.

Once the above draft regulations are implemented, it will cause hidden danger to children's products in Shenzhen and even the whole country.


To this end, in late December last year, the Shenzhen municipal market supervision bureau, the municipal entry exit inspection and Quarantine Bureau, the municipal WTO affairs center and the municipal Standards Institute jointly organized the United States children's products technical regulations bulletin meeting. More than 20 experts from the national inspection and quarantine system, the Standards Institute, the national toy Standards Committee, the Shenzhen toy industry association and other related enterprises were seriously conducting the deliberations. Finally, the municipal Standards Institute drafted the representative's comments on China and submitted it to the United States according to the WTO related working procedures, so as to minimize and avoid possible trade losses caused by the relevant technical regulations of the United States to domestic enterprises.

WTO/TBT (WTO agreement on technical barriers to trade) stipulates that any member of the WTO should notify other members of the draft before issuing new regulations and new standards that may affect trade. Other members have the right to make comments on the draft according to the WTO rules, so as to eliminate all kinds of unreasonable international trade barriers, establish reasonable and fair international trade order and rules, and avoid unnecessary trade barriers.

According to the statistics of the municipal Standards Institute, WTO has been established for 16 years, with more than 20 thousand newly formulated or revised technical trade measures announced by members, accounting for more than 70% of all trade related measures, and this data is increasing at an annual rate of over 2500 items.


Statistics show that in the past 10 years after China's entry into the WTO, China has commented on 3651 important technical trade measures announced abroad.

In recent years, the degree of participation of domestic enterprises in the activities of notification evaluation has been increasing. Many comments have been accepted and accepted by relevant countries.

At the briefing, some experts pointed out that although the Chinese government is paying more and more attention to the TBT review, as a big foreign trade market, the degree of Shenzhen enterprises' participation in TBT evaluation is not high.

Many foreign trade enterprises are still in the stage of passive adjustment of design and production when they are still in the stage of foreign trade regulations after the introduction of foreign trade technical barriers. Enterprises can intervene earlier and express their views in a timely manner.


It is understood that due to the large number of drafts issued annually by various countries and the large number of industries, the state can only comment on key areas and key countries. Although some draft documents have not been listed as key points at the national level, once implemented, they will have a significant impact on some industries and regions.

Li Meng believed that the relevant associations and enterprises should turn from passive acceptance of foreign trade regulations to timely and active tracking of relevant drafts. If the bill was considered unfair or had a significant impact on the industry, it could be actively reflected through the corresponding channels and strive to influence the draft of the draft through appraisal.


Shenzhen enterprises' participation in the TBT bulletin evaluation has the advantage of "close proximity".

In 2010, the Shenzhen municipal market supervision bureau and the State Administration of standards and regulations center, the Shenzhen inspection and Quarantine Bureau and the Municipal Trade Organization Affairs Center jointly signed the "strategic cooperation framework agreement on technology trade measures". This means that Shenzhen will have more opportunities to host the national TBT bulletin Council, and Shenzhen enterprises are more likely to express their opinions and suggestions on relevant trade barriers in the announcement.


In addition, the city standard institute uses the portal website technical barriers resource network of Shenzhen market access platform for the first time to disclose the information of WTO members' notification of the new draft regulations. Relevant enterprises can not only pay attention in time, but also conduct online reviews on foreign reports during the appraisal period.
